In Texas, Alprazolam (trade name Xanax) is assigned to Penalty Group 3 under Section 481.104 of the Texas Health and Safety Code.The factors that determine the penalties for a drug offense include: 1) the type of drug, 2) the amount, and 3) what you intended to do with the drug.

Xanax is commonly prescribed and FDA approved for the medical treatment of panic disorder, generalized anxiety disorder (GAD), social anxiety disorder (SAD) and other anxiety disorders. Xanax is taken orally and possesses sedative, hypnotic, skeletal muscle relaxant, and anticonvulsant properties.

There is a substantial risk of abuse and dependence in patients and non-medical users of alprazolam (Xanax) and it is one of the most commonly prescribed and misused benzodiazepines in the United States. Benzodiazepines are recreationally the most illegally abused pharmaceuticals because of their widespread availability.

Xanax – A Penalty Group 3 Substance

The penalties for Xanax-related charges include the following:

  • Class A Misdemeanor –Possession of less than 28 grams is punishable by up to one year in jail, a maximum $4,000 fine, or both.
  • Felony of the Third Degree – If the individuals possessed 28 grams or more but less than 200 grams, the offense is punishable by 2 to 10 years in prison, and up to a $10,000 fine.
  • Felony of the Second Degree – If the amount possessed was 200 grams or more but less than 400 grams, it is punishable by 2 to 20 years in prison and up to a $10,000 fine.

If the individual possesses 400 grams or more of Xanax, the offense is punishable by 5 to 99 years in the Texas Department of Criminal Justice, and a fine not to exceed $50,000. Under Section 481.114, manufacturing or delivering a substance in Penalty Group 3 is a state jail felony if the amount is less than 28 grams. The offense is a felony in the second degree if the amount is 28 grams, but less than 200 grams. The offense is a felony of the first degree if the amount is 200 grams but less than 400 grams, punishable by 5 to 99 years and a maximum $10,000 fine.
