Because marijuana has not been decriminalized as it has in some other states, in Texas, a conviction for even a very small amount of marijuana can be punishable by up to 6 months in jail. Depending upon the amount of marijuana that you are convicted of possessing, the fines and jail time can vary.

The penalties for up to 1 pound of marijuana being in your possession can earn you anywhere from 6 months to 2 years in jail or prison. It will also carry a fine of anywhere from $2,000 up to $10,000. If you do not have any prior felony convictions and you are arrested with an amount up to 1 pound of marijuana, the law mandates that the judge must impose a sentence of probation and drug treatment for a duration of the judge's choice. Usually the judges will impose drug treatment to be successfully completed, and leave the amount of treatment time necessary up to the drug treatment provider.
